Fintech Bankrolla skewered by AAT

26 March 2019 4:28PM
Bankrolla - now trading as Billfolda - is a 'crowd funding' fintech that's struck out a third time in a quest to use 'bank' in its branding. The Administrative Appeals Tribunal of Australia has ruled that TMeffect Pty Limited and its principal, Matthew Pinter, cannot use the term.In 2016 APRA originally refused consent under s 66 of the Banking Act 1959.An earlier decision of the AAT found in favour of the firm now known as TMeffect. The Federal Court overturned that decision on an appeal by APRA."I am not satisfied this is an exceptional case justifying the granting of consent. On the contrary, this seems to be just the type of case which the legislature might have contemplated when it imposed the prohibition on the use of the word bank," AAT deputy president Ian Molloy ruled.
